Week 9 EOC: Wall Street Journal Opinion

From a legal stand point Obamas newest “guideline” is a tad bit confusing to me. Recently Obama came to a conclusion and has decided to exempt Colorado and Washington of the “federal law “. In more simple terms, “The administration also issued new guidelines for all U.S. attorneys on the dynamic issue of marijuana law, recommending that they only focus on prosecuting major cases”. This is targeted to the issue of marijuana in those states because these states have legalized the drug, though that still means it is not covered by federal law. I for one don’t believe the legalization is the worst thing that could happen but in a technical sense it is still not legalized! Yes, Colorado and also Washington have legalized it in there state but at the end of the day our president is the one who could truly... (to be cont.)

Prosecutorial resources aren't unlimited, and some crimes deserve more enforcement attention than others.

Because after the November referenda Democrats introduced legislation to exempt Colorado and Washington states from federal marijuana law. Under the Constitution Congress can't pass laws that apply in some states and not others.

Not since Nixon have we seen a Presidency so disdainful of the law, but at least Nixon had enough respect for legal appearances to break the law on the sly

Week 6 EOC: Illicit Trade

Illicit trade is illegal, not sanctioned by law, and something that I am completely against in general. My take on illicit trade is it is done to cut corners, and get away with something that shouldn’t be done in the first place, and I do not in any way support that. Morally illicit trade is completely wrong and it is unethical. It is breaking a law and it hurts many people along the way. When someone is involved in illicit trades it is not for the good, and if it is in their mind “for a good cause” it is still very much wrong.

Legally illicit trade is what it is and that is illegal. If someone is caught doing an illicit act they are faced with consequences and if someone is found to be doing illicit trading the same goes for them. This trend is becoming far too easy and the products being traded are becoming easily available for criminals. Financially illicit trade is horrible for our economy and globally it is affecting our economical systems and rules. These activities are experiencing a boom because of society’s needs for things like more drugs, firearms, and counterfeit goods. This only means one thing, that hard working people will lose out on money due to illicit economy, and I do not support criminals making big money as hard workers suffer.

I also have such a hard time with the illicit trade because in my field of work, Fashion Marketing and Retail management, we have a lot to lose. Retail products being illicitly made and sold affects my career personally, and we have to find a way to put this to an end for the sake of citizens and their careers everywhere.

Week 5 EOC: Apple-Samsung Patent Battle

The Apple Samsung saga continues. Apple and Samsung are back in court again over the patent battle of the century. The last time Apple and Samsung went head to head in the courtroom, Apple was set to receive a little over 1 billion dollars but ended up only being rewarded 450 million. Apple then brought Samsung back in the courtroom to “increase the amount of damages it was awarded by several hundred million dollars, and to ban Samsung from selling certain products that infringe on Apple patents”. Apple first went after Samsung in April 2011 when they realized they had blatantly copied the iPhone and iPad. Samsung suggested that they did not copy these products and went on to counter sue Apple for software infringement. The jury found Samsung guilty, assigned them to pay Apple 1 billion dollars, then the judge ruled differently and only awarded $450 million to Apple, and also refused to ban Samsung’s smart phones. Samsung continued on and sued Apple once more claiming that Korean patents were in fact being used and Apple was doing so illegally. What happened next was the following: “The International Trade Commission ruled in favor of Samsung in June 2013, and said the Apple phones in question couldn't be sold within the United States.”

   Now the latest trial going on was brought about by Apple, “In February 2012, Apple filed another lawsuit in California district court accusing Samsung of infringing on utility patents in its newer products.” Samsung is firing back stating that is what Apple is doing with all of their products. Both companies I believe have errors in the way they have gone about certain situations, but that is how the game is played with these big companies. For either company to claim that they haven’t done something even a little unethical would be a lie. And at the end of the day is it all worth it? Apple you are still #1 in the game! “Bottom line on Apple v. Samsung: "Apple remains most profitable phone maker by a wide margin." I would really like to know what their ideal end game scenario would be. As of now the last counter sue brought on by apple is still ongoing and the courts already seem to be tired of all the companies back and forth claims. The trial is set for March 2014.

Week 4 EOC: Edward Snowden

The story of Edward Snowden is too complicated to choose just one side and run with it. Snowden is not a saint but I don’t feel as though he is a vicious criminal and our country should blacklist him. There are many opinions on why what Snowden did was so wrong, leaking the NSA information many people felt was putting "Americans at risk" and constitute a "giant violation of the law.", but with opinions like these also comes opinions from the opposite side of the spectrum like Peter King comparing it to the jobs of reporters, should they be prosecuted for the “leaked” information they publish? He then goes on to raise the biggest question, "I think on something of this magnitude, there is an obligation both moral but also legal…”, yes what Snowden did was technically illegal, but was It the right thing to do?

In my opinion I believe that Snowden had the correct intentions to an extent, I don’t believe he is an innocent citizen because at the end of the day there are laws that make it very obvious that Snowden did cross a line. Though I don’t agree with Ralph Peters rant about Snowden receiving the death penalty but I do believe legally, there should be a consequence. Though I do have a little compassion for Snowden, what he did was treason and he knew what he was getting himself into before he ever spoke a word of the NSA secrets. As Snowden entered a career with the NSA, there are surely contracts that swore him to secrecy of some extent, also

Week 3 EOC: Rolling Stone Magazine

The Rolling Stone article on the Boston bomber “Dzhokhar Tsarnaev” aka Jahar was a very enlightening yet controversial look into the life of the “monstrous” young man. Though the magazine stirred up enough drama and anger from consumers for allowing Jahar to be on the cover of the magazine, the article is sure to stir up some drama of its own. The article shines a little light into the dark and depressing life of Jahar and painted a picture of a troubled young man, with a dark and truly disturbed family. Though we know Jahar is guilty of one of the most horrific attacks on our country, was it lawful for the reporter of this story to dig so deep? To say some of the things that were said, and to collect so many different opinions of Jahar and his upbringing?. One issue this article raises is a fair trial and whether or not this article just made it that much harder to do so. Although it is pretty apparent that Jahar is guilty of all crimes committed, there is something to be said about the bias in this article. A fair trial would insinuate that the jury had no bias against, in this case, Jahar but when you print an article and print it in one of the worlds most popular magazine we are making it that much harder to find an un biased group. Jahar could even goes as far as to turn around and claim “defamation” to his name from the article and all opinions within it. Slander is another claim Jahar can take from an article if this nature. Now Jahar is no saint and it is very unlikely that these claims if he would choose to run with them would even get off of the ground, but the fact that businesses like rolling stone are even leaving the options open needs to be done very carefully. If they continue to produce articles like this it is making it easier for people to turn the tables and hold the reigns.

Week 2: EOC- Stand your ground.

In 2005 Florida passed the “Stand your Ground” law. Stand your ground is a law that allows people to “stand their ground”, defend themselves outside of their homes with deadly force, if they feel their life is in danger. Florida explains it in these terms, “to prevent death or great bodily harm to himself or another or to prevent the commission of a forcible felony”. There are 2 other parts to this law, one being that the citizens do not have a duty to calm the situation or to remove themselves from the situation, also this law provides immunity from prosecution ad civil action when it comes to the use of justifiable force. Stand your ground laws are at times even called the “Shoot first law” due to the many different opinions on this law. According to the Tampa Bay Times “Stand Your Ground law has been invoked in more than 200 cases in Florida where charges were dismissed or defendants were acquitted or not charged at all”. Not everyone believes this law is very "lawful", the stand your ground law has an infamous reputation of being the "shoot first law" because of the fact that there is no rule within this law that shooting without retreat is lawful, if you feel danger whether the other person is armed or not, you may bring out your weapon and "defend yourself". Though the states don’t seem to be budging on this law now that people are more aware of it, it already has begun conversations, though events that led to spotlighting this law were unfortunate it has sparked conversations and has the people wanting better for their country and these are thing that should be happening, and not because a child has died. There are pros and cons to everything and the same goes for stand your ground laws, but as of now its not going anywhere so the best thing we can do is to educate ourselves because in the end education is the best weapon.

Week 1 EOC: My Voice

My voice..

My name is Krystel Bockholt and I study Fashion Marketing. My goal is to style other and design fashion apparel. My styling will be done anywhere and everywhere I want to provide services for women on the go. As a busy lady myself I know it's hard to find time to pamper yourself and I want to bring that experience to my future client. Fashion is such an important part of your life and it brings me joy, I want others to feel the same thing. 

As a Fashion Marketing major I look forward to building businesses of all types and these businesses will include different aspects of the fashion world. Styling is my primary career, I not only want to offer my on the go styling here in Las Vegas I'd like to have an office based in a fashion capital (ex. Los Angles, New York).

Overall I just want to my my clients happy in whatever I am doing. Bringing people joy will always be my main goal and to do that through fashion is a dream come true.
